1Acceptance of terms
By accessing or using the W5D platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all terms and conditions, you must not access or use the Service. These Terms apply to all visitors, users, and others who access the Service.
2Description of service
W5D provides a software-as-a-service platform for workflow automation, data management, and team collaboration. The Service may include updates, new features, and modifications at any time at our sole discretion. We reserve the right to discontinue any portion of the Service with reasonable notice.
3Accounts and registration
You must provide accurate, complete, and current information when creating an account. You are responsible for safeguarding your password and for any activity occurring under your account. You must notify us immediately of any unauthorized use. We reserve the right to terminate accounts for violation of these Terms.
4Acceptable use policy
You agree not to use the Service to: (a) violate any applicable law or regulation; (b) transmit unsolicited communications; (c) reverse engineer or extract source code; (d) attempt to gain unauthorized access to our systems; (e) upload malware, viruses, or destructive code; (f) infringe any intellectual property rights; or (g) engage in fraudulent activities.
5Data and privacy
Your use of the Service is subject to our Privacy Policy. You retain ownership of the data you input into the Service. By using the Service you grant W5D a limited license to process your data solely to deliver the Service. We implement industry-standard security measures to protect your information.
6Billing and payments
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or stated in our refund policy. We reserve the right to change pricing with 30 days notice. Failure to pay may result in service suspension or termination.
7Intellectual property
The Service, including all content, features, and functionality, is owned by W5D and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service. Your feedback and suggestions may be used by us without compensation or attribution.
8Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
9Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, W5D SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM.
10Termination
Either party may terminate these Terms at any time. Upon termination, your right to use the Service will immediately cease. We may retain your data for a reasonable period to comply with legal obligations. Sections relating to IP, disclaimers, liability, and governing law survive termination.
11Governing law
These Terms are governed by the laws of Vietnam without regard to conflict of law provisions. Disputes will be resolved in the courts of Ho Chi Minh City, Vietnam. If any provision is held unenforceable, the remaining provisions remain in effect.
